In fact, the Civil Section of the Supreme Court of Cassation intervened to support what has just been said. Pres Scotti Rel. Caiazzo - with Sentence no. 4721 of 02.21.2020 with which it established that "The registration of a domain name that reproduces or contains the trademark of others constitutes a counterfeit of the trademark since it allows to link the activity to that of the trademark owner, exploiting the reputation of the sign and thus drawing an undue advantage from it. It follows that only the owner of a registered trademark could legitimately use it on their own site or as a domain name ". It is therefore undisputed that the use by third parties of a domain name that follows the name of the registered trademark represents a typical counterfeit conduct.

Therefore, in addition to being extremely important to register your own trademark, it will be equally important to register your domain name in order to protect the virtual market from possible diversion of customers.
